How we, our technology partner, and your ISP handle information when you use eSphere.

1. When This Privacy Policy Applies
Scope of what this document covers — and what it doesn't.
This Privacy Policy describes how Evolution Digital handles information in connection with the eSphere mobile app, the eSphere sensors, and the features delivered to your household through eSphere. It applies whenever you use eSphere or submit information directly to Evolution Digital — for example, through the legal and privacy contact channels described in Section 12.
All eSphere customer communications — including service announcements, support, billing, and account updates — are handled through your ISP, not directly by Evolution Digital. Routine eSphere service and support questions, including hardware, installation, billing, and account issues, should be directed to your ISP, who is your primary point of contact for the eSphere Service.
2. Who's Involved with eSphere
The three parties behind your eSphere experience and what each handles.
Three separate companies work together to deliver eSphere to your home. Each plays a different role, and each has its own privacy responsibilities.

3. Information We Collect
What Evolution Digital receives — and what we don't.
Evolution Digital is a brand and distribution licensee. We do not operate the underlying eSphere technology platform; that is run by Ubiety on its own infrastructure. As a result, the information Evolution Digital directly receives is narrower than the information processed through eSphere overall.

Customer support information
If your ISP contacts Evolution Digital via a support email, web form, ticket, or any other Evolution Digital channel, we may receive the account and contact details, message, and any attachments you provide.
Marketing and communications signups (if any)
If you sign up to receive emails or other communications from Evolution Digital, we receive your name and email address and any preferences you set.
Aggregate and de-identified analytics from Ubiety
Evolution Digital may receive aggregate, de-identified, or pseudonymized usage and performance information from Ubiety to help us understand how eSphere is being used at the program level and to improve the customer experience. This information is not intended to identify individual households or individuals.
Sensor hardware telemetry (eDM)
Evolution Digital operates a device-management tool called the Evolution Device Manager (eDM), which receives hardware telemetry and diagnostic information from eSphere sensors — for example, sensor health status, firmware version, uptime, Wi-Fi RSSI, and connectivity diagnostics — indexed by sensor serial number. eDM does not receive customer names, addresses, account credentials, or other directly identifying information from the sensor, and is not designed to associate multiple sensors with the same household. The purpose of eDM is to monitor device-fleet health and support hardware diagnostics, not to track individual users.
Information your ISP shares with us
ISPs may share limited operational information with Evolution Digital in connection with the eSphere program, such as program-level performance metrics, escalations regarding specific devices, or aggregate participation data. The specific scope of what an ISP shares is governed by the agreement between Evolution Digital and that ISP.
Information processed through the eSphere platform (operated by Ubiety)
When you use eSphere, the following types of information may be collected and processed through the eSphere app and sensors. This processing occurs on Ubiety's infrastructure, and is described here for transparency:
- Device and network attributes — for example, MAC addresses (real or randomized), IP addresses, device type, host name, and Wi-Fi network identifiers, used to identify devices on your home network.
- Profile and household configuration — names you assign to profiles, presence-device assignments, household roles, untrusted-profile flags, and scheduled-arrival times.
- Detection and presence events — entries, exits, new visitor and repeat visitor events, sensor connectivity changes, and similar event-level data.
- App usage information — features used, screens visited, alerts viewed, schedule configurations, and SmartChats messages exchanged through the app.
- In-app notifications and messaging delivery — push notifications and in-app messages delivered to your device through the eSphere platform.
- App-side technical telemetry — app version, mobile operating-system version, app error logs, and crash diagnostics.
Hardware-level sensor telemetry (sensor health, firmware version, and hardware diagnostics) is described separately under "Sensor hardware telemetry (eDM)," because that information flows to Evolution Digital's device-management tool rather than through the Ubiety platform. Some operational telemetry may overlap between the two systems.

Information your ISP collects (separate from this policy)
Your ISP collects information for billing, account management, and delivery of your home internet service. This typically includes your physical address, payment information, account credentials, and broader internet-service usage data. Evolution Digital does not receive that information from your ISP, and it is governed by your ISP's privacy policy, not ours.
4. How We Use Information
Why information is collected and what it's used for.
Evolution Digital and Ubiety use information in connection with eSphere to:
- Provide, operate, and improve eSphere services.
- Communicate with your ISP about your account, support requests, and service announcements.
- Send you alerts and notifications you have configured (for example, presence alerts, schedule-based alerts).
- Personalize your experience within the eSphere app.
- Maintain the security and integrity of eSphere and our systems.
- Detect and prevent misuse, fraud, or unlawful activity.
- Comply with applicable law and respond to legal requests.
5. Data Storage and Security
How information is protected at rest and in transit.
Information processed through the eSphere platform is stored on infrastructure operated by Ubiety, primarily by AWS, under contractual security and confidentiality obligations between Evolution Digital and Ubiety. Industry-standard encryption is used for information in transit and at rest. More information can be found at https://esphere.io/privacy-security/.
Information that Evolution Digital receives directly (such as customer support correspondence and marketing list data) is stored on systems operated by Evolution Digital or our service providers, with access limited to authorized employees and contractors who require it for their work.
6. How Information Is Shared
The limited circumstances in which information moves between parties.
Evolution Digital does not sell your personal information. We share information only in the situations described below.
With Ubiety, our technology partner
Information processed through eSphere flows to and from Ubiety as the platform operator. This sharing is governed by an agreement that limits Ubiety's use of the information to operating and improving eSphere.
With your ISP, in limited circumstances
We may share program-level operational information with your ISP — for example, escalations involving specific sensors, hardware return logistics, or aggregate usage data. We do not share the contents of your eSphere app with your ISP for marketing or advertising purposes.
When required by law
We may disclose information when we believe in good faith it is required by law, legal process, or to protect rights, property, or the safety of users or the public.
Business transactions
If Evolution Digital is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction, subject to confidentiality protections.
Non-personal, aggregated, or de-identified information may be shared for analysis, research, or industry-reporting purposes.
7. California Residents
Your rights under the California Consumer Privacy Act (CCPA).
California residents have certain rights regarding their personal information under the California Consumer Privacy Act (CCPA), as amended. You may have the right to:
- Know what personal information has been collected about you.
- Request a copy of that information in a portable format.
- Request correction of inaccurate information.
- Request deletion of certain personal information.
- Opt out of any sale or sharing of personal information for cross-context behavioral advertising. Evolution Digital does not sell personal information or share it for cross-context behavioral advertising.
- Be free from discrimination for exercising any of these rights.
8. Children's Privacy
Who eSphere is intended for.
eSphere is intended for adults. Account holders must be at least 18 years old, or the age of legal majority in their jurisdiction. Evolution Digital does not knowingly collect personal information from children under 13.
If you believe a child under 13 has provided personal information to us, please contact your ISP so they can take appropriate steps to delete it.
9. Cookies and Automated Technologies
How we use cookies and similar tools.
eSphere's mobile app and any related Evolution Digital websites may use cookies, mobile-app SDKs, and similar technologies to collect technical and usage information. These tools may store unique identifiers, user preferences, and session data.
You can manage cookies through your browser settings, and you can adjust tracking-related settings on your mobile device. Some features of eSphere may not function properly without these technologies.
10. Your Choices
How to manage information about you.
You have the following options:
- Update your eSphere profile and household information directly in the app.
- Update your account contact details with your ISP — your ISP manages billing and primary account information.
- Request deletion of your eSphere account by contacting your ISP.
11. Updates to This Privacy Policy
How we'll let you know if this policy changes.
We may update this Privacy Policy periodically. The Effective Date at the top of this document will be revised when changes occur. Material changes may also be communicated through the App, by email, or through other reasonable means.
This Privacy Policy covers Evolution Digital's information practices only. Your ISP and Ubiety may update their own privacy practices independently and without notice from Evolution Digital.
